beat brokering! haha. Ive been in a situation where people have dropped 250-500 on exclusives from me. The album never came out, or these guys went to jail, or disappeared from the face of the earth. Resold the beats...no problems.

This happens to majors all the time. People will get dough for beats that go on albums that get canned/dropped... then the beat is up for grabs again. I heard kayne used to put a clause in his contracts saying if the record didnt go major/distribution in 2 years he could resell the beat. He made alot of indies upset doing this... apparently.

Id say... structure your non exclusive deals this way. People are more or less using these for mixtapes and demos... and in turn going to get deals. I see no harm in selling a track non exclusive and then exclusive. Who the hell would pay $25-50 for a beat and make some classic song out of it!? My feeling is... that everyone is a rapper now days and there is a lot of shit out there. Play off of this until your break comes. "Screwing over" a bunch of basement gangsta rappers on myspace and the internet shouldnt be a concern.

Just imagine this situation. Most of these sites are selling mp3's of your beats. In most cases. In the old days you handed out a beat CD or sent it in the mail to artists. If they wanted a beat, they would buy it from you. If they wanted to jack or use the beat they could do that too. But how many people are beat jacking shit then putting out legitimate releases? The way I see it... the $25 non exclusive is the same as sending out a beat or beat cd and letting the artist decide if they wanna use it or record over it. You could send the same beat to one hundred people, they could record it, but technically nobody can really "use" it until they throw some money at you for the exclusive.

Non Exclusive - is a tax for use of something for whatever purpose.

Just my opinion. I hope that makes sense.

The difference between hustling a non-exclusive and exclusive beat is relative.

It depends on whether the other party is willing to invest in a lawyer to stop you.

Probability is that they're not, and if they have that kind of money, they will try to contact you and do a legit deal aka buyout-- with an actual lawyer.

Is someone going to really sue you cause you sold a beat? (if they're in your neighborhood, they might kick your ass, but that's a different story.)

The music business is pretty amoral. You have to be ruthless to survive (but pretend you're actually not ruthless and a "good" guy).
